Is DeepSeek Safe? A Workplace Guide to Data, Hosting and the US Ban

DeepSeek can be considered for public-data work, but confidential inputs need approval of the exact service, host and contract. The US federal restriction made public on October 19, 2026 adds a separate test for government work: local hosting alone does not settle it. DHS notice and signed order.

Is DeepSeek Safe? Separate the Service, Model and Permission

Approve a specific use of DeepSeek, not the brand in general. DeepSeek, the AI developer whose legal entity is Hangzhou DeepSeek Artificial Intelligence Co., Ltd., supplies hosted services and downloadable models. Those create different relationships with your information.

For an owner or IT lead, “safe” needs separate answers:

  • The service: Who receives prompts, files and logs, and under which terms?
  • The model: What software runs, how does it behave, and what can it access?
  • Permission: Do your contracts, data obligations and applicable restrictions allow this use?

A good answer in one category cannot substitute for the others. Keeping a customer document inside your network does not establish that the generated answer is accurate. A model that performs well on your task does not establish permission to send it that document.

Verified on October 20, 2026: DeepSeek's live policies and API documentation, the government notice and signed appendix, and the hosting and model documentation cited below. The decisions here are an analysis of those sources, not results from penetration tests or an audit of a deployed system.

Hosted DeepSeek: Where Your Inputs Go

DeepSeek's own chat service and its direct API both involve sending requests to DeepSeek. An API, the interface software uses to request a model's response, does not make processing local merely because staff use it through an internal application.

Is DeepSeek App Safe for Work?

DeepSeek's browser service at chat.deepseek.com is the hosted chat route. Treat its mobile app as a hosted service too, rather than as a downloaded model running privately on the phone.

The privacy policy, updated February 10, 2026, says: “we directly collect, process and store your Personal Data in People's Republic of China.” It lists prompts, files, chat history and device information among collected data, and model training and improvement among processing purposes. It tells users not to submit sensitive personal data.

Retention depends on purpose and legal obligations; the policy gives account lifetime as an example, rather than a universal short deletion deadline. It also describes service-provider access, search-keyword sharing and disclosure under stated legal-request conditions. These are documented processing arrangements, not evidence that every conversation is reviewed by a government. DeepSeek privacy policy.

The Terms of Use, updated March 27, 2026, say DeepSeek “may, to a minimal extent, use Inputs and Outputs” to operate and improve its services, subject to the clause's encryption and de-identification qualifications. They describe an opt-out by turning off “Improve the model for everyone”. That setting addresses the specified improvement use; it does not promise local processing or immediate deletion.

For a founder drafting a public event announcement, the practical boundary is straightforward: supply already published details and review the draft. For an operations lead rewriting a customer complaint, replacing the customer's name alone is not a sufficient approval process. The remaining story, attachments and account details may still reveal the customer or your business.

The general terms also require checking published outputs and identifying their AI origin. Shared conversation links can expose the conversation to anyone with the link. Keep customer records out of share links and make human approval part of publication. DeepSeek Terms of Use.

The DeepSeek API Has Its Own Contract Surface

Do not treat a direct API integration as an automatic confidentiality upgrade. The API documentation identifies https://api.deepseek.com as the official base URL. A familiar client library or a chat interface inside your company does not change that destination.

DeepSeek

The Open Platform Terms of Service, effective April 29, 2026, supplement the general terms. They cover applications for internal use and external users, require protection of API credentials, and place downstream privacy duties on the developer.

For downstream users, the API terms state that “the processing rules for their collected personal information are not covered by this privacy policy.” The developer must provide the relevant privacy policy and establish the required basis for processing. This allocates responsibility; it is not a promise that DeepSeek never receives, retains or uses API inputs. DeepSeek API terms.

The API terms reviewed here do not supply a blanket no-training or zero-retention commitment. Do not assume a consumer chat setting applies to an application's API traffic. Before approving confidential inputs, obtain written answers covering the exact service and account: processing location, training use, retention, deletion, access and contractual protection.

If those answers remain unresolved, keep the pilot on synthetic examples: invented support tickets, fabricated customer records and code with no business secrets. Plan mechanics belong in the separate DeepSeek pricing guide; a billing relationship alone is not a privacy control.

Third-Party Hosts: Read the Model Page and the Data Terms

A host that operates DeepSeek weights can keep prompts away from DeepSeek, while a proxy may simply forward them. A proxy is an intermediary that relays a request to another service. The presence of “DeepSeek” in a model selector does not tell you which arrangement you have.

Amazon Web Services (AWS) offers Amazon Bedrock, its managed model service, with DeepSeek models listed on AWS's own model pages. AWS states that Bedrock does not share inputs or outputs with model providers, and that AWS and those providers do not use them to train the base models. That is an explicit host statement, rather than an inference from the model's name. AWS data-use explanation.

Amazon Bedrock

AWS separately documents retention controls that depend on the configured account, project, region and model requirements. No provider sharing, no model training, and no retained content are different commitments. Review the actual deployment settings and your application's logging. Amazon Bedrock retention documentation.

Together AI, another model-serving platform, also lists DeepSeek models in its own catalog. The listing establishes that the platform offers the model. It does not make AWS's data terms applicable to Together AI, or establish the location and retention rules for every Together deployment.

For any third-party host, record the operator that actually computes the response, the selected region, any onward routing or fallback, the parties with access, and how prompts appear in monitoring and support logs. If the sales description says “US hosted”, ask whether that covers inference, storage, backups and support access. A company address is not a complete data-flow description.

These are different data destinations. The independent-host route assumes the host runs the model itself and does not forward prompts to DeepSeek.

The approval should identify the endpoint, the network address receiving requests, alongside the model and the host. This lets IT detect a meaningful change if a supplier later switches from independent inference to a forwarding arrangement.

Is DeepSeek AI Safe When You Run the Weights Yourself?

Independent deployment changes who receives data; it leaves you responsible for the system that handles it. Open weights are downloadable model parameters, the learned values used to generate responses. Think of them as bringing the engine into your own vehicle: you choose the surroundings and controls, but still need to assess the engine and the assembled vehicle.

DeepSeek's official DeepSeek-V4.1-Flash repository supplies weights and local-inference instructions. Inference means using the model to produce a response. For version context, see DeepSeek V4 explained.

If those weights run entirely on your hardware, with outbound communication disabled and no external service receiving content, your prompts do not go to DeepSeek. The same separation can hold when an independent US host operates the weights under its own service. This is an architectural condition, not a claim that every product labeled “local” or “US hosted” has been verified.

Check the whole path: the chat interface, model runtime, diagnostic reporting, search, document processing, backups and optional fallback APIs. A local inference engine does not prevent an attached search tool from sending a query elsewhere. Require the deployment owner to document and verify permitted outbound traffic.

Supply-Chain Review Still Applies

Approve the downloaded files and the software that loads them. The supply chain includes the repository, model revision, runtime, dependencies and deployment image. Model availability is not an audit of those components.

Hugging Face's Transformers security guidance recommends the safetensors file format, inspecting custom code before enabling trust_remote_code, and pinning a specific revision to avoid unexpected changes. It also supports offline use of pre-downloaded weights. These are useful installation precautions, not a guarantee about model behavior. Transformers security policy.

For the technical owner, a reviewable deployment record should name the original publisher, exact downloaded revision, applicable license, approved dependencies and service permissions. Run it without unrelated credentials or broad filesystem access. Make updates an explicit change, with a route back to the previous approved configuration.

A solo builder may be comfortable owning that work. A business owner without someone responsible for patching, access and incident response should not approve a sensitive deployment simply because a local setup guide exists.

Is DeepSeek Good Enough for the Decisions Staff Will Make?

Evaluate the task before granting the model authority. A private response can still be wrong, biased or unsuitable for a consequential decision. The National Institute of Standards and Technology (NIST) describes these as general generative-AI risks; they are not a DeepSeek-specific test result. NIST generative-AI risk profile.

Build an acceptance set from work you understand: a support question with a known policy answer, a request the assistant should decline, an incomplete document that should produce uncertainty, and a code change whose behavior you can verify. Include the languages and sensitive topics your staff encounter. Record unsupported statements, inappropriate refusals and omissions before deciding where human review is needed.

Prompt injection is another concern: untrusted content can introduce instructions that conflict with the application's intended rules. Hosting location does not remove that class of attack. NIST prompt-injection definition.

For a support assistant, treat an instruction embedded in a customer attachment as customer content, not permission to export records. Start with draft-only answers and narrow access. Keep sending messages, changing records and running commands behind explicit controls. Those are design recommendations, not claims that any DeepSeek deployment passed them.

What the DHS Order Changes for Work

The restriction concerns covered federal civilian executive branch systems and procurement, and includes third-party implementations. Its reach is broader than blocking the DeepSeek website.

The date matters. The notice was filed on October 19, 2026 and published on October 20, 2026. The signed appendix identifies July 24, 2026 as the order's original release date. Calling it an order first issued in October would conflate public notice with issuance. DHS notice and signed order.

DHS directs covered agencies to exclude DeepSeek and affiliated products from procurement and remove covered technology, including third-party products and services developed using DeepSeek implementations. The order provides an agency exception process. Its wording does not establish an automatic exemption for independently hosted weights. Official order.

Is DeepSeek Safe to Use in USA Workplaces?

For a private company, the narrow conclusion from this notice is that it is not a blanket ban on all private use. It also is not permission under every other law, customer agreement or sector requirement. For covered federal work, a US hosting address alone does not resolve eligibility. DHS order and scope.

A supplier building software for a federal civilian customer should identify embedded models and take the proposed architecture to its contracting and legal contacts before making a compliance representation. Include a model accessed through another vendor, not just direct DeepSeek accounts.

An ordinary private retailer evaluating public marketing copy can instead start with its own data rules and supplier review. Do not copy a government procurement decision into a company-wide legal claim, or assume that a private-company deployment is acceptable to a government customer.

Is DeepSeek Safe to Use With Your Company's Data?

Use the input's sensitivity to set the approval threshold. This table gives recommended defaults for a private organization. An applicable prohibition or customer restriction overrides a technical approval.

“Conditional” means the data owner and responsible IT or compliance lead have approved the exact deployment, purpose, access and contract. It does not mean that the provider has certified your use case.

Use caseDeepSeek chat or direct APIIndependent hostYour own hardware
Public dataAllow a limited, approved pilot with output review. Exclude secrets and personal details added by the prompt.Allow an approved pilot after checking routing and terms.Allow an approved pilot after software review.
Customer dataHold identifiable or confidential records pending explicit data and contract approval. Use synthetic examples meanwhile.Conditional on permitted processing, access, retention and onward transfers.Conditional on authorization, isolation, access and log controls.
CodePublic examples can fit a pilot. Hold proprietary source, credentials and production logs pending approval.Conditional for private code; verify host terms and restrict tool permissions.Conditional for private code; inspect dependencies and isolate execution.
Regulated dataDo not use as a default staff tool. Require a use-specific legal and compliance decision.Consider only after verifying the service, required agreements and controls for that workload.Consider only after verifying the full system and applicable obligations. Local storage alone is insufficient.

For customer data, a useful boundary is whether the proposed input is approved for that recipient, rather than whether a staff member believes it looks harmless. A complaint can combine personal information, a confidential commercial arrangement and internal notes.

For code, review both directions. Sending source out is a disclosure decision; executing generated code is a separate operational decision. A public example may be suitable input while its suggested command still needs review before running against production.

For regulated work, send the actual workflow for review: what information enters, what decision comes out, who relies on it and where it is stored. A provider's general security page cannot answer those organization-specific questions.

What's Overhyped About DeepSeek Safety?

The least useful claims collapse separate decisions into a single verdict. Avoid these shortcuts:

  • “All DeepSeek use sends prompts to DeepSeek.” That ignores genuinely independent inference. Verify the route instead of inferring it from the model name.
  • “A US host makes every use permissible.” Location is only part of the decision. The federal restriction expressly addresses third-party implementations.
  • “Turning off training means nothing is stored.” Training use, inference processing and retention answer different questions.
  • “Open weights mean audited software.” Download access does not establish that the installed stack or its responses have been assessed.

The useful position is neither blanket reassurance nor blanket alarm. Authorize a defined task with defined data and a responsible owner. For a broader workflow choice, use the DeepSeek vs ChatGPT comparison, then apply the same deployment-specific review to the selected service.

Is It Safe to Use DeepSeek? Make the Approval Specific

On Monday, replace informal permission with a written approval that names the data destination. The owner sets the allowed purpose, IT documents the service, and the operator confirms how staff will use and review its output.

Clay courtyard approval path checks allowed data, approved host and permitted use before human review, with a hold path for unresolved checks
A successful hosting review cannot override a data restriction or a prohibition on the use itself.
  1. Record the actual service

Inventory staff chat accounts, application endpoints and model-serving vendors. Name the operator, model, environment, approved users and person responsible for changes.

  2. Set the data boundary

List what employees may submit and what requires approval. Give examples drawn from your work, such as public product descriptions versus customer complaints. Start unresolved cases with synthetic inputs.

  3. Resolve hosting and permission

Save the relevant terms and approval record. Document routing, retention, access, external tools and contract restrictions. Escalate covered federal work to the responsible contracting and legal contacts.

  4. Limit authority and revisit changes

Choose who checks outputs before customers or systems rely on them. Reassess when the host, model, terms, data type or tool permissions change. Give staff a clear route to report an accidental disclosure or unexpected action.

Put those decisions into the AI acceptable use policy. A small company can begin with public-data tasks; a CTO considering internal document access needs a documented deployment review; a builder adding tools needs permission controls around each action.

Frequently Asked Questions

Are .AI websites safe?

Treat the domain suffix as a name, not an approval signal. Identify the operator, inspect the applicable terms and decide whether the exact service may receive your information.

Is DeepSeek a security risk?

The useful assessment is of the service, deployment and task. Hosted data handling, software provenance, model behavior and permission to use it need separate answers. This article does not claim a measured security score.

What not to tell AI?

Keep credentials and secrets out of prompts. Do not submit confidential business documents, identifiable customer records or regulated information unless that specific use and service have been approved. Public source material can still become sensitive when you add internal instructions or attachments.
